As a data processor, Averetek is committed to staying compliant to the new General Data Protection Regulations (GDPR). To do so, below is an overview of the policies we have put in place to be compliant with the GDPR, as well as the planned series of changes to the software before the May 25th, 2018 deadline.

Consent

Where applicable (landing pages, list upload, etc.), Averetek is adding consent mechanisms to capture the consent of the individual being marketed to by users. This will involve a physical mechanism, e.g. a check box, and consent language accepting the partner’s privacy policy. This consent will be logged and attainable by lead, partner, or client request.

The right to be forgotten and the right to data portability

Individuals (lead, partner, or client) may delete any of their personal information should they request to do so. They will also have the ability to request a copy of the data we have stored in an export format such as PDF, Excel, etc. To request a copy of said data, individuals can email support@averetek.com with the request. Averetek will deliver this data within 48 business hours.

  • Clients: In the instance that a client user no longer needs access to the Averetek platform, a platform admin can write to support@averetek.com and request that their account and all of their data be deleted.
  • Partners: If a partner terminates their contract, it is up to the partner to request that their data be deleted. A partner can request at any time to have their data deleted by submitting a request to support@averetek.com. A partner can at any time download any lead capture data and delete contact lists that they have uploaded.
  • Leads: If a lead requests to be removed from a particular partner’s instance, the lead will only be deleted from the lists that are linked to the specific partner.  If the lead exists on lists of other partner’s lists, their details will not be deleted unless requested.

Access Control 

Partner users can only see contact lists and lead details as added by those in their organization and cannot see details for other organizations. The application requires the data controller use the data for marketing purposes only. Only data required for prospecting is allowed in the system.  The following is a list of standard fields/data we capture on all forms. These fields can vary from client to client and is not an exhaustive list.

  • First name
  • Last name
  • Email
  • Company
  • Job title
  • Phone number (event registration only)

Logs and Data Retention

Averetek keeps a record of data changes and users will be able to make changes to personal data, should they decide to do so. Averetek will keep all platform data until the client terminates their contract with us. Data will still be accessible upon request until 90 days after the termination date. It is up to the client or partner to decide how long to keep and store partner or lead data in the system.

The following is a list of partner details that are stored in Averetek:

  • Account name
  • Account ID
  • Account mailing address
  • Account Type (Distributor,  Reseller, etc)
  • Account Level (Gold, Platinum, etc)
  • Account logos (these get merged into the co-branded marketing templates)
  • Account phone number [Partner adds to profile]
  • Contact first and last name (individual at partner organization)
  • Contact email address

All data is stored on servers based in the US at a data center with industry-standard security measures.   

Launch

GDPR features and updates will be launched in the following phases. Phase 1 will ensure GDPR compliance, phase 2 will include improvements to current features, and phase 3 will address anything outstanding after the first two phases. More details about each phase are below.

Phase 1

  • Averetek will add required consent checkboxes on all landing pages and templates that use a form.
  • Averetek will add consent copy, tied to the checkboxes mentioned above, that links to the partner’s privacy policy located in their profile.
  • Averetek will add a consent mechanism, e.g. checkbox, when users upload contact lists,  confirming they have received consent to market to the contacts on that list.
  • Averetek will add backend systems, such as audit tables, to capture and track these new consent mechanisms.

Phase 2

  • Averetek will introduce a double-opt-in email template to capture and confirm opt-ins and email addresses.
  • Averetek will create a subscription center to better access, edit, or delete data.
  • Averetek will make changes to the My Contacts page, creating a more user-friendly view of unsubscribes, consent, etc. for clients and partners.
